The Patriot Act: Alleged Abuses of the Law (and Open Thread)

Alleged Abuses of the Law

Critics of the USA Patriot Act say the law has made it too easy for law enforcement to spy on people. They contend that, by easing restrictions on the
use of surveillance tools once reserved for foreign-intelligence investigations, the law cuts too deeply into personal liberties and privacy rights.

The Justice Department dismisses these objections, saying there have been no reported abuses of the act and no substantiated claims that civil rights have been violated.

But civil liberties groups say that because the act mandates secrecy about many of its uses, Americans may never know whether their privacy has been violated by law-enforcement investigators relying on the act's powers.

Oh wait. That was 2005. My bad. It's now 2009, and a liberal democrat is in the White House. So, never mind. Forget we said anything. It's all good:

Obama supports extending Patriot Act provisions

WASHINGTON – The Obama administration supports extending three key provisions of the Patriot Act that are due to expire at the end of the year, the Justice Department told Congress in a letter made public Tuesday.

Lawmakers and civil rights groups had been pressing the Democratic administration to say whether it wants to preserve the post-Sept. 11 law's authority to access business records,
as well as monitor so-called "lone wolf" terrorists and conduct roving wiretaps.

The provision on business records was long criticized by rights groups as giving the government access to citizens' library records, and a coalition of liberal and conservative groups complained that the Patriot Act gives the government too much authority to snoop into Americans' private lives.

Well, what does the Left have to say about it now?

Michelle Richardson of the American Civil Liberties Union called the administration's position "a mixed bag," and said that the group hopes the next version of the Patriot Act will have important safeguards on other issues, particularly the collecting of international communications, and a specific bar on surveillance of protected First Amendment activities like peaceful protests or religious assembly.

"We're heartened they're saying they're willing to work with Congress," Richardson said, adding that is "definitely a sea change from what we've seen in the past."

See? All better.

Anyway, good morning everyone! I hope you're all having a good morning! Let's enjoy the morning news over a cup of coffee, shall we?

  2. I am of two minds wether the patriot act was a good thing or a bad thing over all. If the left wing rights groups turn turtle on this I will definitely know that they are all full of it. I just hope that the right wing crazies don't jump all over this like the left did back in the day.

  4. Yeah sos, I think it's a hoot. The government requires you to sign up and give over lots of personal info for a drivers liscence or a passport. If you are getting even more involved they will require even deeper questioning. I have been fingerprinted at least 3 times by government agencies. Once by provincial police, and twice by the military. All for id's and background checks. The Government issues you a social insurance number, and requests you to file a yearly income tax form at the mimimum. All the information they need is at their finger tips already. It's too late to keep them out of your life.

I can think of only one way to get them out of our pockets, documents, and personal histories. Unfortunately that way is barbarism.

I heard/read something somewhere about personal privacy. It went along the lines that maybe all the privacy we can get or need in the future will just be what's in our heads. Sometimes I think that's the truth, and there's no need to fight over privacy issues. Another thing I heard growing up, almost zen like, "Who owns your face?".

  10. Well I have to say that while anectodal evidence should be taken with the proverbial grain of salt, I never really felt like my civil rights had been infringed upon - well, though, there was the one time at the airport when I took off my shoes and was SO embarrassed to see a hole in my sock, but still.
And of course all the wiretaps were from America OVERSEAS to known or suspected Terrorist locations. Oh and of course cell phones don't enjoy the freedom from wiretaps that landlines do, cause cellphones are considered to be radio transmitting devices and therefore ANYONE can listen in with a scanner. No Fourth Amendment protections for cell phone calls.
Of course, there is that matter the ACLU is so concerned about, the right to peacefully protest, even if the protests compared Bush to Hitler. Ooops, that should be Obama to Hitler.
Wait,no both Bush and Obama were compared and Obama is still compared - unfairly of course- to Hilter, but that only happened after Obama was elected POTUS otherwise folks would have said "Hitler to who? Who is this 'Obama' fellow?
But the ACLU,in spite of 7+ years under Bush with NO significant terrorist attacks, still felt obliged to protect our civil rights, even if another 9/11 should occur - while Bush was POTUS anyway.
Now that the biggest liberal (LEFTY) is POTUS the ACLU can breathe a sigh of relief because the Administration has indicated a willingness to work with Congress! Gosh, that sure makes me feel safer about my civil rights! Of course, if I really thought the ACLU was truly interested in supporting my civil rights I'd feel even better about it.

    ReplyDelete
  11. Well said and stated realwest. It's funny how the ACLU will jump up and scream about abuses from republicans, but will give democrats a pass. I will cheer for them when they stand up for things that are trampling all rights.

  12. Hey PaladinPhil - even with all that information that the govenment has about your personal life, they still can't bring themselves to require a State or Federal issued Photo ID for voting.
Hell for that matter, they can't even paint your finger purple to show that you've already voted! HAH! We'll teach those Iraqi's a thing or two about one-person-one vote!
Oh, wait, we don't even do that.

  15. Shocker of the day.

Ethics panel defers probe on Jesse Jackson Jr.

WASHINGTON (AP) - The House ethics committee says it will defer an inquiry of Rep. Jesse Jackson Jr. at the request of federal prosecutors investigating former Illinois Gov. Rod Blagojevich.
The committee is looking into Jackson's interactions with Blagojevich (blah-GOY'-uh-vich), who has been indicted on corruption charges including alleged attempts to sell President Barack Obama's former Senate seat.

  17. realwest: I find it amazing that voters don't have to show id in the states when they vote. I have to show current id, with a voter registration card. If I don't have that I must show a piece of mail with my current address. And the piece of mail must be either a bank statement, a credit card bill, or government communication. That's checked against a list of voters for the riding. If my name isn't on the list I must fill out a form and sign it on the spot after showing all my id. I don't know how stringent it is in the states for voting, I just know how it's done here in Canada.

    ReplyDelete
  18. Shocker of the day.

If it means what I think it means, it means that Jesse Jr. may be in deeper trouble than a little "ethics" violation.

  23. How are you feeling today, real ?

Want to thank you for having me here.

    ReplyDelete
  24. Well you know PaladinPhil, the reason the Democrats say we shouldn't require voter registration photo ID's is that it's too difficult or expensive for the Elderly, infirm or poor to be able to get Photo IDs.
Of course, the fact that the Elderly and the poor at least STILL have to get a photo ID to drive a car in all of the 50 or 57 states I believe, doesn't seem to give the Democrats any pause at all.
And besides, you know how awful most Driver's license photos are, right? Well imagine how they'd look if they were photos of dead people.

IT IS ABSOLUTELY DISGUSTING THAT WE REQUIRE PHOTO ID'S FOR DAMN NEAR EVERYTHING IN THE U.S., EXCEPT FOR VOTING.

    ReplyDelete
  25. I'm loving every minute of it.

    Me too.

On a related note, the Baltimore office of ACORN? A blast from the not-so-distant past:

    http://www.youtube.com/watch?v=vRrHZGTdhKw

"This is our house now," said Louis Beverly, ACORN.

And on Thursday afternoon, they literally broke the foreclosure padlock right off the front door and then broke into the house, letting Hanks back in for the first time in months.

"We are actually trespassing, and so this is a way of civil disobedience to try to stay in the house," said Beverly. "Legally it's wrong, but homesteading is the only means that she has left to stay in her house. And we feel as though this is the right thing to do at this particular time to save this family."

    ReplyDelete
  26. Oooooh, I like the sounds of this growing technology. I just hope it gets here fast enough so that I can keep my current laptop current for a few more years.

    ReplyDelete
  27. The other thing the left went nuts over was phone records being gathered.

1st point phone records belong to the phone company, not the individual. Any "privacy" is limited by the contract you have with the phone company.

Second they weren't real time watching phone calls, that was only for already flagged overseas known persons of interest.

They were compiling records of Point of orgination, point of termination, time and duration.

The purpose was to be able unravel a rat line.

Suppose a call orginates in Pakistan from a person of interest, a good operation wouldn't call the intended reciept, a message would be passed from phone to phone, with the actual receipient somewhere in the middle. A good operation would also can random numbers and either leave a message or talk briefly if some one answered to confuse those trying to roll up the rat line.

An individuals phone record wouldn't even be looked at unless it was tied to rat line.

  29. Of course, the fact that the Elderly and the poor at least STILL have to get a photo ID to drive a car in all of the 50 or 57 states I believe, doesn't seem to give the Democrats any pause at all.

That, and how do they cash their Social Security or other "government" assistance checks without photo ID?

It's all bullshit for the sole purpose of enabling voter fraud - the only way liberal democrats can win it all.

    ReplyDelete
  30. Interesting link RB. I liked the end of the article: "As you all can see, Donna is reclaiming her home, and she's putting a lock on her door at this time," said Beverly.

But that padlock won't stay there for long.

The current property managers told Eyewitness News they were unaware of ACORN's actions Thursday and were contacting the police and their lawyers.

I wonder what the outcome was in that situation.

I actually hired someone to come in and look. My personal computer is also one of the business computers - and we are self-employed. There was no way I could try to figure it out by myself without betting the business.

But another thing - Microsoft had downloaded some stuff in the background that no longer recognized my standard email login. That's a bet the business issue too. If I can't send docs to staffers, we are truly fucked.

So. Reset the Microsoft default email and upgrade to I E 7 - which I'm told is much more secure. Who knows? I hate them anyway. The very nice gentleman who came to help downloaded Firefox and put an icon on my desktop to play with.

Maxine Waters wants the teapartiers looked into by the media, maybe they'll get some coverage now:

"The media should investigate the racial views of conservative activists like the ones who descended on Washington last weekend, one liberal congresswoman said Wednesday.

Rep. Maxine Waters (D-Calif.) said that it's not enough for African-Americans to levy allegations of racism against the right-leaning protesters, and that the media must look into their views.

"I want those people talked to; I want them interviewed," Waters told the liberal Bill Press Radio show in a podcast. "I want journalists to be all over those rallies and the marches with the birthers and the teabaggers."

"What I'm looking for is the very people who carry the signs who are referring to the policies in very, very strange ways like 'Obamacare' and 'Barry Obamacare with Kennedy,'" she said. "What I've been interested in is hearing from those people that everybody's referring to -- everybody on the Mall, in the rally."

  86. Bwaaaahhhhaaaaa!!! The provincial and Federal wings of the liberal party are having issues over their talking points.

Ignatieff's camp has denied that he had a deal with the premier, but wouldn't clarify his stance on the HST, which Ignatieff has publicly derided as the "Harper Sales Tax."
McGuinty says he will move ahead with the single tax no matter what.
The two Liberal leaders appear to be out of sync on the blended tax, which has sparked controversy because it will raise the cost of many items currently exempt from provincial tax.

  87. SOunds like ol' Maxine wants everyone who was in the mall, and at the rallys, "interviewed".

No. Media coverage is that last thing she, or any other liberal democrat, wants. They want to stifle dissent.

    Dissent is no longer patriotic.

  88. Hey, no problem Pink. Me and littleoldlady go back to the old days of the LNDT. One of the few things I missed when I was moved off of night shifts.

  89. RB: Maxine just likes getting attention.

I can see her now, going through a stack of sign pics from the rally, "Keep this one, this one this one .....all of those over there, throw 'em away."

  102. Rabbit Bait weighs in, if some who has been weighed and found wanting could weigh in.

“I think it’s based on racism,”

“There is an inherent feeling among many in this country that an African American should not be president.”

“I think an overwhelming proportion of the intensely-demonstrated animosity toward President Barack Obama is based on the fact that he is a black man, that he is African American.”

“That racism inclination still exists, and I think it has bubbled up to the surface because of a belief among many white people, not just in the South but across the country, that African Americans are not qualified to lead this great country,”

“It’s an abominable circumstance, and grieves me and concerns me very deeply,”

Rabbit Bait, BHO so far hasn't come close to the disaster your 4 years was. You however were simply incompetent.

BHO on the other hand does have a "color" problem but it ain't his melanin concentration, it the "color" of his politics, which are tinted a nice red color.

  103. I just want to puke 6th stabbing incident since the start of the school year. The last part of the article is where I want to hurl.

Ward 9 trustee Maria Rodrigues said psychologists and sociologists offered counselling during what she called "a group hug day."
Rodrigues was confident "this was an isolated incident" and the school does not need a full-time cop.
Having a uniformed officer would create "fear and intimidation," since many students are from families who emigrated from countries with dictatorships and distrusted police, she said.
She welcomes police visits to host events and talk about recruitment, but a full-time presence "creates a military air," Rodrigues said.

    Also in school news.

What does a deep blue city school super suggest when grades and graduation rates fall?

Seattle schools may lower grade-point requirement for graduation

Seattle Public Schools may do away with a nearly decade-old requirement that all students earn a C average to graduate, and an even-older policy that athletes maintain a C average to play on school teams.

If the School Board approves recommendations endorsed by Superintendent Maria Goodloe-Johnson, as well as most district high-school principals and counselors, a D average will be good enough to earn a high-school diploma. Student athletes would need to pass five of six classes with D grades or better.

Why this superintendent still has a job is beyond me.

Don't turn out people who actualy know how to navigate the real world, people with thinking skills rooted in the experience of generations gone before.

Nope, they want dependants who'll vote for Hope-n-Change every time.

  108. Gah, it reminds me of so many stories I have read about the future. It seems in some of them the first thing that has gone is the education of the youth. No one wants critical thinkers anymore it seems. We may be writing our own death sentence for the future while we watch.

  110. Rapping Joe’s Knuckles
    By MAUREEN DOWD

“When we are done here today,” said the man who accused the president of lying, “we will not have taken any steps to improve the country.”

Actually, Wilson is dead wrong again. When House Democrats, and a handful of Republicans, reprimanded the congressman on Tuesday evening for refusing to apologize to his colleagues for breaking the rules, it was quite a wonderful way to improve America.

It was a rare triumph for civility in a country that seems to have lost all sense of it — from music arenas to tennis courts to political gatherings to hallowed halls — and a ratification of an institution that has relied on strict codes of conduct for two centuries to prevent a breakdown of order.

Just how ignorant are you of the history of your own business? Go back 100 years and look at the civility of the old two partisan papers in every town. You ain't see nothing sweetie (BHO's phrase).

    Civility? What you taking about.

    Here is your "civility":

Right: I'm opposed to the health care bills as proposed because they cost too much, and take liberty and health care choice away.

    Left: RACIST RACIST RACIST

    Yep, that's civil discourse.

BTW, 'ole Joe Wilson was speaking the truth, a little out of place but the truth. I thought you old lefties liked speaking "truth to power."

    I hate that phrase anyway.

Your definition of civil discourse I guess means silencing the opposition with non-sequetors.

"Harper said he welcomed America's renewed engagement in Afghanistan, where Canadian Forces have been fighting for eight years.

Obama, who called Harper an "outstanding partner" to the United States, said he was "tremendously grateful for the extraordinary sacrifices of the Canadian military" in Afghanistan."
